Clovux agrees to furnish services to the Subscriber, subject to the following ("Terms of Service"). Clovux, the company hereafter referred to as, ("Clovux "), ("Us"), ("We") and The Client, ("Customer"), ("Client") and ("You"). Use of Clovux services constitutes acceptance and agreement to our AUP ("Acceptable Use Policy") and ToS ("Terms of Service"). All provisions of this contract are subject to change from time to time at the discretion of Clovux. Subscriber understands that change to the ToS by Clovux shall not be grounds for early contract termination or non-payment.
Refund and Disputes
Minecraft servers and web hosting plans are eligible for refunds within one twenty-four hour day of the creation of the server/hosting account in our database, this point is not marked by the time at which your initial payment is processed and may differ by several hours or days. All refunds are made through the gateway in which initial payments were made. All of our other services, including product addons are not eligible for a refund. In order to receive a refund, a ticket must be opened and probable cause must be explained. Refunds are not issued when a cancellation request is made by a client on their service. In addition to this, non-monthly terms are non-refundable. Our 24 hour money back guarantee applies to a new client's first order only. Refunds issued for billing errors are made on a per case basis.
To terminate your services you must cancel any PayPal subscriptions active and cancel via our WHMCS billing area at https://clovux.net/billing. As Clovux does not have access to client's PayPal accounts, we cannot and will not be responsible for unintended payments made from using the automatic payment subscription service.
Invoices for recurring services will be generated 14 days prior to the due date of the service.
Unpaid services will be suspended (service made temporarily unavailable) 3 days past the due date of the service.
Unpaid services will be terminated (files permanently deleted) 7 days past the due date of the service.
Clovux can not be held responsible for loss of data due to termination from overdue invoices.
A late fee of 10% will be applied for invoices of terminated services (minimum $0.10 fee). This is to cover the admin cost of reactivation of these services.
Liability Limitation and Exclusion
Clovux, under no circumstances, shall be held liable for any data loss, disruption of information, or distribution of information including that of unauthorized access to our server systems or any other loss of data. We reserve the right to terminate a client's services in the event of a charge dispute, despite the outcome of the dispute.
Any support requests required for products from Clovux shall be submitted through the billing system via tickets, via Livechat or via the email listed on the About page. Any other form of contact other than these is not guaranteed a proper answer from an official representative.
Clovux guarantees 99.9% uptime on its Minecraft and web hosting services. In the rare event of any unplanned downtime outside of this SLA, Clovux will compensate the client with 5% of the monthly cost of the affected service per hour of downtime, up to 100% of the monthly cost of this service. The compensation will be applied as credit to the client's billing account with Clovux and can then be used to pay future invoices.
Clovux cannot guarantee that all promotion codes will work all of the time.
Clovux retains the right to seek and consult with any appropriate authorities that may need to be involved in the event of an issue arising whether it is through violation of this policy or any other illegal occurrence requiring involvement of law-enforcement agencies. Clovux regards any communication between parties as confidential, upon distribution of any communication, unless prior approval is in place, we will take action to the full extent of the law. By purchasing a server from Clovux you permit us to modify your server, this includes, but is not limited to, changing plugins, updating Bukkit/server software and other tasks related to running a Minecraft server. Any verbal or written statements to compromise our server systems or any other equipment owned by Clovux will be taken seriously and will result in further investigation and possible lawsuits. Upon cancellation of payments to Clovux your server will be suspended unless prior arrangements are made. Clovux retains the sole right to stop, start, and modify your server.
While we offer unmetered disk space to our Minecraft hosting customers, we reserve the right to request that you delete excessive files such as logs, backups or anything else we deem excessive. Any uploaded files that cause the server to lag or make the server unplayable are not the responsibility of Clovux.
If we find your server using any sort of system to bypass limits put on your server such as RAM amount, your server is subject to being terminated without refund. In addition to this, intentional CPU abuse is also not tolerated.
Additionally we reserve all rights to terminate your server or service upon any violation of these terms or any other basis if deemed needed.
Acceptable Use Policy
Clovux services may not be used for illegal purposes, or in support of any illegal activities. Clovux reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrong doing.
Using of the Clovux services to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property is prohibited. Harassment Using of the Clovux services to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another is also prohibited.
Forgery or Impersonation
Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.
Use of Clovux service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as "pyramid schemes" and "chain letters."
Use of the Clovux service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Clovux or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending Clovux account is subject to immediate termination and further investigation.
Network disruptions and unfriendly activity:
Use of the Clovux service for any activity which affects the ability of other people or systems to use Clovux Services or the Internet. This includes "Denial of Service" (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Member's responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. This includes "unsolicited/bulk email" (spam). A Subscriber may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorized entry and/or use of another company and/or individual's computer system will result in immediate account termination. Clovux will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.
Fraud involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it. Fraud is strictly prohibited and offenses will be investigated. Third-party Links, Sites and Services Our Products may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Clovux. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from Clovux, you do so at your own risk and you agree that Clovux will have no liability arising from your use of or access to any third-party website, service, or content.
Dedicated Server/VPS Terms:
All of the above terms also apply to dedicated servers/VPS sold by Clovux. In addition to these, there are a number of terms that apply exclusively to dedicated servers/VPS:
We do not offer refunds on dedicated servers/VPS due to installation costs.
Setup takes up to 72 hours, you will receive an email with the installation details once the machine has been set up. Setup may take slightly longer if you requested for additional services such as Multicraft to be installed. If a Windows install is requested, it will be installed as unactivated. The install can then be activated by the client if desired.
Currently no panel is provided with dedicated servers/VPS. Manual reboots/OS reinstalls can be requested via Technical Support ticket.
VPS Pre-order Terms:
All of the above terms also apply to VPS pre-orders from Clovux. In addition to these, there are a number of terms that apply exclusively to our VPS pre-orders:

VPS pre-orders are not delivered instantly after ordering. The average delivery time is 24 hours, and this may vary depending on the level of stock available.
Server Management & Details:
VPS pre-orders will come with SolusVM panel for management. Reboots, reinstalls etc can be performed in this panel. VPS pre-orders are located in North America unless stated otherwise and use OpenVZ virtualisation.
